Welcome to Diveconnect.io (the "Platform"). These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and Dive Connect, LLC, a limited liability company organized under the laws of the State of Florida, United States ("DiveConnect," "Company," "we," "us," or "our").
These Terms govern your use of the Diveconnect.io website and the DiveConnect mobile applications for iOS and Android (together, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and our Community Standards. If you do not agree, you must not use the Platform.
2.1. A neutral venue. The Platform is an online marketplace and technology service that connects Users with independent Dive Providers. You understand and agree that we are not a party to any contract entered into between a User and a Provider. We do not own, operate, control, staff, supervise, or provide any Dive Service, and we are not a dive operator, dive shop, training agency, travel agent, or tour operator.
2.2. No endorsement or guarantee. While we may apply a vetting or verification process to Providers, we do not endorse, guarantee, or control the quality, safety, legality, credentials, insurance, or suitability of any Provider or Dive Service. Information about Dive Services is supplied by Providers, and we are not responsible for its accuracy.
2.3. Providers bear all in-water responsibility. Each Provider is solely responsible for the safety, supervision, equipment, certification verification, medical screening, insurance, and lawful operation of its Dive Services, and for collecting its own liability waiver and medical forms from every participant. These obligations are set out in our Provider & Operator Agreement.
2.4. Release. To the fullest extent permitted by law, you release Dive Connect, LLC and its affiliates, officers, directors, and employees from any and all claims, demands, damages, and liabilities of every kind, known and unknown, arising out of or connected with any dispute with a Provider or any Dive Service.
All Bookings are subject to our Cancellation & Refund Policy, which is incorporated into these Terms by reference. It governs your deposit — including when it is refunded, when it is forfeited, and when it may be converted to booking credit — and you should review it carefully before booking.
Fair use. To keep places available for divers who intend to dive, deposits and booking credits are non-transferable between people, and booking credit is valid for 90 days, redeemable on any listing, and has no cash value. If you make repeated late cancellations — two or more within a rolling 12-month period — your future deposits may become refundable as DiveConnect booking credit only, rather than to your card; we disclose this at checkout before you pay, never after the fact. We may also decline, cancel, or suspend Bookings or accounts that show fraudulent or abusive patterns, such as booking to hold a Provider's capacity with systematic cancellation.
6.1. Provider responsibility. As the seller and Merchant of Record, each Provider is solely responsible for determining, collecting, reporting, and remitting all taxes and government charges on its Dive Services — including income tax, VAT/GST, sales tax, tourist or occupancy levies, and port or marine-park fees — to the appropriate authorities.
6.2. Prices may exclude local charges. Prices displayed may not include all local taxes, levies, or fees charged at the destination — for example marine-park entry fees or marine-conservation fees such as a reef tax. Unless stated otherwise, you may be responsible for paying those directly to the Provider or local authority.
6.3. Platform's role. DiveConnect does not provide tax advice and is not the Providers' tax agent. Because the price of the dive is paid to the Provider directly and DiveConnect charges only its own booking deposit, DiveConnect is not a marketplace facilitator for the Dive Service and does not collect or remit tax on it; any tax on the dive is the Provider's responsibility and is collected by the Provider.
7.1. Certification and experience. You are solely responsible for holding the valid diving certifications required for the Dive Service you book and for presenting proof to the Provider on request. The Provider may cancel your participation, without refund, if you cannot demonstrate the required certification.
7.2. Medical fitness. You are solely responsible for being medically fit to dive. We strongly recommend you review a recognized diver medical statement (such as the PADI/SSI Diver Medical) and consult a physician before booking. The Provider may decline your participation, without refund, if it determines you are not fit to dive.
7.3. Assumption of inherent risk. You acknowledge that scuba diving, freediving, and related activities are inherently dangerous and carry significant risk of serious injury, illness, disability, or death, including from decompression sickness, embolism, drowning, marine life, and equipment failure. By making a Booking, you voluntarily and expressly assume all such risks.
7.4. The Provider's own waiver governs the dive. You acknowledge and agree that the Provider will require you to sign the Provider's own liability release, assumption-of-risk waiver, and medical statement before you enter the water, and that the Dive Service is governed by those forms and the Provider's safety rules. Any acknowledgment you accept at checkout on the Platform is in addition to — and does not replace — the Provider's own waiver and medical screening.
The Platform includes social, community, review, and messaging features. Your use of these features is governed by our Community Standards. You retain ownership of content you post and grant DiveConnect a worldwide, non-exclusive, royalty-free license to host, display, and distribute it for operating and promoting the Platform. Copyright complaints are handled under our DMCA / Copyright Policy.
You agree not to use the Platform for any unlawful purpose, to circumvent the deposit or book off-platform to avoid it, to misrepresent your identity or credentials, to harass or endanger others, to scrape or interfere with the Platform, or to violate our Community Standards.
10.1. Disclaimer of warranties. The Platform is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and do not warrant that Dive Services will meet your requirements or that the Platform will be uninterrupted, secure, or error-free.
10.2. Limitation of liability. To the fullest extent permitted by law, Dive Connect, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from: (a) your access to or use of, or inability to use, the Platform; (b) the conduct or content of any third party, including any Provider; or (c) any Dive Service, including any accident, injury, illness, death, or property damage occurring during or as a result of a Dive Service.
10.3. Maximum liability. In no event will Dive Connect, LLC's aggregate liability for any claim arising out of these Terms or your use of the Platform exceed the total booking/service fees you paid to us for the specific Booking giving rise to the claim.
You agree to defend, indemnify, and hold harmless Dive Connect, LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Platform, your Bookings, your content, or your violation of these Terms.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute arising from these Terms will be resolved by binding arbitration in Tampa, Florida, United States, except for claims for injunctive or equitable relief.
We may modify or replace these Terms at any time in our sole discretion. We will provide at least 30 days' notice before material changes take effect. By continuing to use the Platform after revisions become effective, you agree to be bound by the revised Terms. The version in effect when you make a Booking governs that Booking.
